Voting by Mail

Who is eligible to vote by mail?

  • Be 65 years or older
  • Be disabled: (Texas Election Code Sec. 82.002 provides "A qualified voter is eligible… if the voter has a sickness or physical condition that prevents the voter from appearing at the polling place on election day without a likelihood of needing personal assistance or of injuring the voter's health.")
  • expected to be absent from the county or,
  • confined in jail.
  • Expected to give birth within 3 weeks before or after Election Day

 When can you apply for a ballot by mail?

  • An application for ballot by mail may be submitted at any time in the year of the election for which a ballot is requested, but not later than the close of regular business in the early voting clerk's office or 12 noon, whichever is later, on the 11th day before election day unless that day is a Saturday, Sunday, or legal state or national holiday, in which case the last day is the first preceding regular business day.

Where can you request or get an application for a mail ballot?

 Can I get assistance with filling out the application?

  • Witness: If you are unable to sign your name (due to a physical disability or illiteracy), the application may be signed for you by a Witness. You must affix your mark to the application or, if you are unable to make a mark, then the Witness must check the appropriate box indicating the inability to make a mark. The Witness must state his/her name in printed form and indicate his/her relationship to you or, if unrelated, state that fact. The Witness must sign and provide his or her printed name and residence address. Unless the Witness is a close relative of the voter (parent, grandparent, spouse, child or sibling), it is a Class B misdemeanor for a person to witness more than one application for ballot by mail.
  • Assistant: If a person (other than a close relative or person registered to vote at the same address) assists you in completing this application in your presence or mails/faxes/e-mails this application on your behalf, then that person must complete the appropriate box. The Assistant must sign, provide his or her printed name, and his or her residence address. A person commits a Class A misdemeanor if the person provides assistance without providing the information described above unless a close relative or registered at your address.

  • Or scan your completed and signed application for ballot by mail, then email it to: VoteByMail@nuecescountytx.gov
  • If you email application, you must also mail the hard copy of the application so that it is received by our office no later than the 4th business day after the day our office received your emailed application.  If you email your application by the deadline noted above, your application will be considered timely as long as the original is received by our office by the 4th business day after it was submitted by email.

Can I still vote in person if I received a mail in ballot?

  • Yes. If you vote early in-person, the mail ballot process will be cancelled at the poll.
  • Yes. If you vote on Election Day, you should take the mail ballot to the polling location to enable voting a regular ballot. If you do not have the mail ballot with you, you may vote a provisional ballot.
